Social Media Basic Policy

Introduction

JERA Co., Inc. (the “Company”) has established this Social Media Basic Policy (the “Policy”) for the purpose of defining the attitude of the Company and a point of view on using social media.

Basic stance

  1. The Company complies with various laws and regulations, and acts with good sense in accordance with the various rules established by the Company.
  2. The Company understands that communication by an individual could lead to evaluation of the Company, and acts responsibly.
  3. The Company clarifies the purpose of communication and provides valuable information.
  4. The employees of the Company are fully aware of the potential impacts of speaking on social media (e.g. posts, likes, sharing), and they speak and respond in good faith.
  5. The Company is always aware that the information disseminated on the internet can be accessed by an unspecified number of users, and that the information once disseminated cannot be completely deleted.
  6. The company respects intellectual property rights, likeness rights, protection of privacy, and other rights of third parties, and will not defame, slander, or insult others.
  7. The Company disseminates accurate information based on facts.

Prohibitions

If any of the following apply to this service, the Company may hide or delete the post, block the account, and take other measures, which we deem necessary or appropriate without notifying the user:

  1. Any posts which have no relation to the posted content of the Company account;
  2. Any posts which violate public order and morals or public welfare;
  3. Any posts for opinions on a particular politician, activist or political party;
  4. Any posts which violate or conflict with the laws and regulations, customs, and social norms of each country or region;
  5. Any posts that fall under defamation, slander, infringement of rights, infringement of privacy, damage of credit, obstruction of business, etc. to individuals, organizations (including the Company), specific social groups, communities, etc.;
  6. Any posts which are associated with discrimination of races, ethnicities, religions, gender, or any other form of discriminations;
  7. Any posts which may cause misunderstanding (such as impersonation) or discomfort to other users;
  8. Any posts which are offensive or may incite conflict;
  9. Any posts which are false or are not based on the fact;
  10. Any posts for commercial purposes;
  11. Any posts for propagating a specific religion or thought;
  12. Any posts which are obviously mischievous or meaningless (a list of meaningless numbers or letters, continuous posts of the same content, etc.);
  13. Any posts which are associated with suicide or self-harm;
  14. Any posts which contain obscene expressions;
  15. Any posts which contain harmful programs, scripts, links, etc.;
  16. Any posts which violate the terms of use stipulated by each social media service;
  17. Any posts that the Company judges to be inappropriate.

Disclaimers

  1. As a general rule, official opinions of the Company on the internet are disseminated only on the website operated by the Company. The accuracy and completeness of the contents which the Company and the employees of the Company post may not always be guaranteed.
  2. The Company may delete or correct the posts if the posts include inappropriate information. In addition, our employees and other related parties may voluntarily transmit their opinions, etc. on our official social media or personal accounts, but this does not necessarily represent our official opinions. The Company will continuously review the Policy as necessary in response to changes in the social media environment.
  3. The Company is not responsible for any troubles, disputes or damages which occur between social media users or between social media users and third parties, even if they are related to the social media operated by the Company.
  4. The responses and comments received on social media are read through as much as possible, however, we may not be able to respond, reply or give reactions such as “like” to all the contents.
  5. We consider the user guarantees the following to the Company by posting content on the Company’s official social media;
    1. a) The user is over 18 years old;
    2. b) If there is an identifiable person in the posted content, the user has obtained consent from the person to post the content on social media of the Company in an official document.
  6. The user is deemed to have granted us access to their accounts and profile information disclosed by our official social media, such as the user‘s name, profile picture, gender, network, user ID, friend list, etc., by completing a post, “like”, or share on our official social media, or by registering as a follower.

Intellectual property rights

  1. Unless otherwise stated, the copyrights or likeness rights and other intellectual property rights to the information (texts, images, videos, illustrations, etc.) which are posted and disclosed on official social media, are owned by the Company. Usage (including duplication, modification, excerpt, translation, publication, and distribution, etc.) of the information without prior permission of the Company is prohibited.
  2. The copyrights of posts (texts, images, videos, illustrations, etc.) disseminated to official social media belong to the poster of the posts, However, at the time of the posting, the poster agrees that the Company is free to use any copyrighted material included in the post and that the poster will not exercise any copyright, moral rights of authors, likeness right, or other intellectual property right against the Company.

Miscellaneous

  1. the Company may revise this Policy without the consent of users. In such cases, the latest Policy shall apply to the use of the Company's official social media. Unless otherwise specified by the Company, the revised Policy shall come into effect from the time the revised Policy is published on the Company's website.
  2. the interpretation and application of this policy shall be governed by the laws of Japan, and in the event of any dispute between the user and the Company, the Tokyo District Court or the Tokyo Summary Court shall have exclusive jurisdiction in the first instance.
  3. If the user causes damage to a third party in connection with the use of the Company’s official social media, the user shall compensate for such damage at the user’s own responsibility and expense or settle any dispute with such third party at the user’s own risk. We shall not be liable for any damage, and users agrees to indemnify and hold the Company harmless from any and all claims, damages and liabilities arising from such events.
